The following terms, conditions, and disclosures are hereby incorporated into the Agreement signed by the Client and AirUltra, LLC. The following terms and conditions are agreed to by the Client (sometimes referred to herein as “you” or “your”) and AirUltra, LLC.
- CREDIT/DEBIT CARD PAYMENTS: You must notify AirUltra, LLC, of any change in account information or payment method. In the meantime, you will remain solely responsible for taking appropriate actions to ensure that payments are made when due. AirUltra, LLC, shall have no liability or responsibility for its inability to process or receive payments that you make or attempt to make via credit or debit card.
- NSF CHARGES: Any NSF charge occasioned by you will be added to your next monthly billing statement (or final billing statement if a termination of service occurs).
- EQUIPMENT: Equipment and wiring supplied by AirUltra, LLC to Client are intended to remain at the service address given in the Agreement and must not be used or relocated off such premises without AirUltra, LLC’s authorization. The Client must return all equipment upon substitution of use or termination of service; failure to do so will result in a charge to be determined in accordance with AirUltra, LLC’s then current schedule of charges for unreturned equipment, which amount shall be due immediately. AirUltra, LLC, may remove or change the equipment at AirUltra, LLC’s discretion at any time service is being provided or at any time following the termination of service. The Client further agrees not to tamper with, sell, lease, abandon, or give away the equipment, or permit any other person to do the same.
- SECURE CONNECTION REQUIREMENTS: AirUltra, LLC shall have the right to implement reasonable measures necessary to track, manage, and/or ensure the security and integrity of AirUltra, LLC’s network facilities, your network facilities, and AirUltra, LLC’s video, phone, and/or Internet signals. AirUltra, LLC shall have the right to suspend, freeze, or otherwise cease service or network access in the event and to the extent necessary to address any network integrity or security concern that may arise with regard to activity on or through, conditions arising from or caused by the use, availability of, or access enabled at or through the Client’s service, service location, equipment, or account.
- OBLIGATIONS ON TERMINATION: The Client agrees that upon termination of the Agreement, the Client will pay AirUltra, LLC, in full for services and equipment through the end of the thirty (30) day term, and will promptly return all equipment to AirUltra, LLC within fifteen (15) days after the termination of the Agreement.
- RATES: All rates, including the rate(s) contained within the Agreement, are subject to change to the extent permitted under law and this Addendum. Client will receive notice of a rate change as provided in the Agreement and may request termination of the Agreement due to the rate change under the terms of that article. If a rate is changed, such change in the Client’s billing statement shall occur on the first day of the Client’s next term.
- RESERVATION OF RIGHTS: AirUltra, LLC reserves the right to refuse, suspend, or terminate service to any person at any time for any reason not prohibited by law.
PRIVACY POLICY
The Client (sometimes referred to herein as “you” or your”) assumes sole responsibility for all privacy, security and other risks associated with providing personally identifiable information to third parties via Internet service. To the extent that AirUltra, LLC is expressly required to do so by applicable law, AirUltra, LLC will provide notice to the Client of a breach of the security of certain personally identifiable information about the Client. In order to protect the privacy of the Client’s account information, AirUltra, LLC may require that the Client use a security code or other method, in addition to the username and password, to confirm the Client’s identity when requesting or otherwise accessing account information or making changes to the Client’s network, equipment, software, and/or other aspects in connection with the services provided by AirUltra, LLC.
In order to provide you with our products and services and to keep you informed, AirUltra, LLC collects some information when you interact with AirUltra, LLC or use AirUltra, LLC’s products, services, websites and applications. This information is used to efficiently provide services to you on a cost-effective basis and to tailor the products and services to best meet your needs and interests.
Information You Provide to Us Directly
AirUltra, LLC collects information you provide when you establish a customer or user account, register to use and/or connect to certain services, and when you contact AirUltra, LLC such as:
- contact information (e.g., name, address, email address, and phone number);
- usernames and passwords;
- information about the types of services to which you subscribe;
- information about your payment methods, such as your payment card number or bank account information;
- information we keep in our records when you correspond or otherwise communicate with us; and
- network information at your residence or establishment.
Information We Collect
When you use the AirUltra, LLC’s services, the following information may be collected:
- information from any device you use when you interact with AirUltra, LLC, including but not limited to the device identifiers, the number, types, and status of devices connected to AirUltra LLC’s network, other networks, network addresses, operating systems, and technical configurations of the equipment used;
- network traffic data; and
- performance and support data.
AirUltra, LLC does not share this data with third parties, but utilizes this data to maintain network security, to provide you with services, to troubleshoot issues, and to maintain your account.
Pursuant to a lawful court order, AirUltra, LLC may be required by law to disclose information about you, including information that personally identifies you, your use of our services, and the content of your communications, to governmental entities upon receipt of valid order from a court of competent jurisdiction. If demanded by such an order, these disclosures may be made with or without your consent and with or without notice, in compliance with the law.
